A medical bill, an insurance payment, and the medical damages allowed in a lawsuit are different figures. A lien also raises separate payment duties.

## Paid medical bills versus lien-based treatment

Howell, Corenbaum, and Pebley discuss different settings involving medical expenses and proof. They do not turn every bill into an automatic award. A lawyer must examine how care was billed and paid, what the person owes, and the evidence of reasonable value.

## What Howell and Pebley explain about medical damages

SB 623 adds Civil Code section 3333.9 for specified network-company and app-based-driver claims arising from crashes on or after January 1, 2027, with exclusions and qualifications. Its 70th-percentile provision is not a blanket rule for every California crash or every medical lien. Do not choose care based on a website’s legal example.

## Court decisions about california crash medical bills: insurance, liens, and damages

### Howell v. Hamilton Meats & Provisions, Inc.

(2011) 52 Cal.4th 541, slip op., pp. 1–2. For the insured care at issue, a bill’s unpaid negotiated writeoff was not a loss the patient could recover.

Limits: This does not decide every bill or lien. Future care and other kinds of loss need separate proof.

### Corenbaum v. Lampkin

(2013) 215 Cal.App.4th 1308, slip op., pp. 3–4. The court rejected using full billed amounts from the care at issue as proof of other losses. The bills were subject to insurance discounts.

Limits: This does not bar proof of all future care or pain. Those losses need an appropriate factual basis.
