After a fatal San Jose crash, a lawyer must first identify who may bring a claim and which kind of claim is involved.

## Records that may help explain fatal san jose car accidents and wrongful-death claims

A family’s wrongful-death claim differs from a surviving claim of the person who died. Code of Civil Procedure section 377.60 addresses eligible wrongful-death claimants. The person’s relationships, the claimed loss, and other circumstances matter; this page does not decide who has the right to file.

## Medical bills and other losses after the crash

Keep documents you already have, including reports and relevant correspondence. You do not need to finish collecting every record before asking about deadlines. A potential public-entity issue, notice, or other special circumstance should be raised promptly with a lawyer.

## Court decisions about fatal san jose car accidents and wrongful-death claims

### Quiroz v. Seventh Ave. Center

(2006) 140 Cal.App.4th 1256, pp. 1263–1265. A family’s wrongful-death claim is not the same as the deceased person’s surviving claim. They concern different injuries.

Limits: These claims have different rules. Later changes to the kinds of loss that can be claimed need review.

### Krouse v. Graham

(1977) 19 Cal.3d 59, pp. 67–72. The court distinguished loss of a loved one’s companionship from grief itself in a wrongful-death claim.

Limits: The case also discussed a separate emotional-harm claim. The rules for that claim need their own review.
